Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the https://www.the-boc.com website and the Boc mobile application (together, or individually, the “Service”) operated by Boc (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms then you do not have permission to access the Service.

Purchases

You must be 18 years or older to purchase products through the Service. By making a purchase, you represent that you are at least 18 years old.
All purchases are subject to Boc’s Return Policy outlined below.
We may revise prices at any time. The prices displayed for products on the Service will be the price charged at checkout.
You agree to pay all charges incurred for purchases made through the Service, including applicable taxes. We reserve the right to place authorization holds on your payment method to verify the available balance for the transaction amount.
Shipping and handling costs will be calculated and displayed at checkout based on weight, dimensions, and your selected shipping method.
To complete transactions, we will share relevant personal and payment information with third parties like payment processors, shipping providers, and fraud prevention services.

Return Policy

If you are not fully satisfied with your purchase, you may return eligible items within 30 days of receipt for a refund. Items must be new, unused, unwashed, and in original packaging with tags attached.
Sale items, personalized products, and gift cards/e-gift cards are final sale and cannot be returned or exchanged, unless defective.
To initiate a return, please contact Boc’s customer service. We will provide return instructions specific to your order.
You are responsible for all return shipping costs unless the return is due to our error or the item arrives damaged or defective. Refunds will be issued once items are inspected by our warehouse team.
Refunds are generally processed within 3-5 business days after receipt of the return. Refunds may take 1-2 billing cycles to appear on your statement.

Intellectual Property

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Boc and its licensors. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

User Content

We may now or in the future offer users of the Service the opportunity to create, build, post, upload, display, publish, distribute, transmit, broadcast, or otherwise make available on or submit through the Service (collectively, “submit”) messages, text, illustrations, files, images, graphics, photos, comments, responses, sounds, music, videos, information, content, ratings, reviews, data, questions, suggestions, personally identifiable information, or other information or materials and the ideas contained therein (collectively, but excluding Boc Licensed Elements included therein, “User Content”).

Subject to the rights and license you grant herein, you retain all rights, title and interest in your User Content. If you delete your User Content from the Service, our systems will remove it within a reasonable timeframe. Note that search engines and other third parties may still retain copies of your User Content that has been publicly distributed.

By submitting User Content, you specifically grant us, our affiliates, partners, subsidiaries, and successors a nonexclusive, transferable, sublicensable, worldwide, perpetual, unlimited, irrevocable, royalty-free license to copy, remix, adapt, translate, publish, license, transmit, distribute, publicly perform, publicly display, store, modify, create derivative works, and otherwise use your User Content in connection with the Service, including commercial or promotional purposes. You confirm and warrant that you have all rights necessary to grant the license granted under this section.

Our Service may contain links to third party web sites or services that are not owned or controlled by Boc. Boc has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Boc shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third party web sites or services that you visit.

Termination

We may terminate your access to all or part of the Service at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your account, you may simply discontinue using the Service.

All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Boc its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Limitation of Liability

In no event shall Boc, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

You agree to defend, indemnify and hold harmless Boc and our licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from: (i) use of and access to the Service, including any data or content transmitted or received by you; (ii) your violation of any term of these Terms, including without limitation your breach of any of the representations and warranties above; (iii) your violation of any third-party right, including without limitation any right of privacy or Intellectual Property Rights; (iv) your violation of any applicable law, rule or regulation; (v) User Content or any content that is submitted via your account including without limitation misleading, false, or inaccurate information; (vi) negligent or willful misconduct.

Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Service at any time or for any reason at our sole discretion without notice. However we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Service without notice at any time.

We will not be liable to you or any third party for any modification, suspension or discontinuance of the Service.

These Terms shall be governed by the laws of the State of Massachusetts, without respect to its conflict of laws principles.
